These terms govern your use of Text Blast Pro. By creating an account you agree to them.
The service
Text Blast Pro is a subscription platform for sending SMS marketing campaigns, managing the replies, and tracking the leads that result. We provide the software, provision and register your sending numbers, and route messages through our messaging providers.
Accounts
You must give accurate information when signing up and keep your credentials secure. You are responsible for everything done under your account, including by people you invite to your workspace. You must be at least 18 and authorised to act for the business you register.
Trials, plans and billing
New accounts start with a 7-day free trial. You choose a plan and add a payment method before the trial begins, but nothing is charged during the trial. Unless you cancel before the seven days end, the plan you selected begins billing automatically.
Plans are billed monthly in advance. Each includes a monthly allowance of outbound message segments and a number of team seats, as shown on our pricing page. Inbound replies do not count against your allowance. If you exhaust your allowance, sending pauses until the next billing period or until you move to a larger plan.
Payments are processed by Stripe. Fees are non-refundable except where required by law.
Cancellation
You may cancel at any time from your billing settings. Your account remains usable until the end of the period you have paid for, after which sending stops and access is restricted. You can export your leads and conversations at any point before then, and for a limited period afterwards.
We may suspend or close an account that breaches these terms, that we are required to close, or that puts the messaging network at risk. Where circumstances allow, we will tell you first.
Your responsibilities when messaging
This is the part that matters most, because getting it wrong harms real people and puts every other customer's deliverability at risk. You agree that:
- You have a lawful basis to contact every person on the lists you upload, and you comply with the TCPA, state telemarketing and calling laws, and any other rules that apply to you.
- You will not use the platform for messages that are unlawful, deceptive, harassing, or that relate to prohibited content categories under carrier rules — including illegal substances, hate speech, or fraudulent offers.
- You will not attempt to evade opt-outs, filtering, or the sending controls in the platform.
- You will honour opt-out requests. The platform enforces these automatically, and you will not work around that enforcement.
- You are responsible for the content of your messages.
We may pause sending on an account that generates excessive complaints or carrier violations, in order to protect the messaging network.
Registration with carriers
We register your brand and campaign with carriers on your behalf, using information you give us. That information must be accurate. Carriers make their own decisions about registration and message delivery, and we cannot guarantee any particular outcome.
Deliverability
We give you the tools and the pacing to send well, but message delivery depends on carriers and mobile networks we do not control. We do not guarantee that any message will be delivered, nor any particular delivery rate, response rate, or business result.
Your data
You own the data you put into the platform. You grant us the permission needed to store and process it in order to run the service. Our handling of personal information is described in our Privacy Policy.
Availability
We work to keep the platform available and do not promise uninterrupted service. Maintenance, provider outages, and events beyond our control can interrupt it.
Intellectual property
The platform, its design, and its software remain ours. You may not copy, resell, reverse engineer, or build a competing service from it.
Limitation of liability
To the fullest extent permitted by law, Text Blast Pro is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost deals, or lost data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
The service is provided "as is", without warranties of any kind beyond those that cannot be excluded by law.
Indemnity
You will indemnify us against claims arising from your use of the platform, the content of your messages, or your breach of these terms — including claims brought by people you have contacted.
Changes
We may update these terms. Material changes will be notified to account holders by email, and the date above will be revised. Continuing to use the service after a change means you accept it.
Governing law
These terms are governed by the laws of the United States and the state in which Text Blast Pro is established, without regard to conflict of law rules.
